1. INTRODUCTION
Reference is made to the Company's announcements dated 17 August 2026 and 28 August 2026 in relation to the ongoing legal proceedings involving the Company and its wholly-owned subsidiary, Wullersdorf Resources Sdn. Bhd. ("WRSB"), and Southsea Gold Sdn. Bhd. ("SGSB") (collectively, the "Previous Announcements").
The Board of Directors of AuMAS wishes to announce the following further developments in relation to the injunction proceedings.
2. 3RD INJUNCTION OBTAINED BY THE COMPANY AND SGSB'S SETTING-ASIDE APPLICATION
The 3rd Injunction is due to expire on 4 September 2026 pending the Court's decision in respect of the inter-partes hearing of the 3rd Injunction and SGSB's setting-aside application.
The Company and WRSB have applied to the Court for an ad interim injunction to preserve the relevant protections pending the Court's decision on 16 October 2026.
The application remains pending before the Court as at the date of this announcement.
3. INJUNCTION OBTAINED BY SGSB AND WRSB'S SETTING-ASIDE APPLICATION
On 3 September 2026, the Court allowed WRSB's application and set aside the ex-parte injunction obtained by SGSB on 14 August 2026.
4. AD INTERIM INJUNCTION OBTAINED BY SGSB
At the same proceeding, the Court granted a limited ad interim injunction pending the inter-partes hearing or further order of the Court.
Under the ad interim injunction, WRSB is restrained from causing, permitting or allowing contaminated water originating from the Tailings Storage Facility ("TSF") to escape, seep, flow or be discharged beyond the boundary of the sub-leased land onto any other part of the main lease land or to any watercourse connected with that land.
The injunction does not prevent WRSB from carrying out inspection, emergency containment, sampling, monitoring, pumping, treatment, neutralisation, repair or remediation works, subject to its terms and any applicable directions of the competent authorities.
The Court further ordered that the ad interim injunction does not change or suspend the earlier Court orders and that SGSB shall not interfere with WRSB's access or genuine inspection, containment, repair or remediation works protected by those orders.
The inter-partes hearing has been fixed for 8 October 2026.
5. FINANCIAL AND OPERATIONAL IMPACT
The above developments are not presently expected to have any material operational impact on the Group, including WRSB's ongoing mining and processing operations.
Accordingly, they are not presently expected to have any material financial impact on the Group, including on its earnings, net assets or gearing for the financial year ending 30 September 2026.
6. FURTHER DEVELOPMENTS
The Company will make further announcements on any material developments in relation to these matters as and when appropriate.
This announcement is dated 4 September 2026.
