Reference is made to the Company's announcements dated 30 March 2022, 25 May 2022, 23 June 2022, 13 July 2022, 13 September 2022, 13 October 2022, 17 October 2022, 11 January 2023, 22 March 2023, 24 May 2023, 2 August 2023, 8 January 2024, 29 April 2024, 27 June 2024, 13 August 2024, 20 May 2025, 11 August 2025, 30 September 2025, 4 December 2025, 5 February 2026, 23 April 2026 and 25 June 2026.

 

The Company wishes to announce that TBSB had, on 13 May 2026, filed an appeal against the entirety of the decision of the High Court delivered at the hearing held on 22 April 2026, whereby the Plaintiff's application under Order 14A of the Rules of Court 2012 (Disposal of Case on a Point of Law) was allowed.

 

During the case management held before the Court of Appeal on 11 August 2026, the Court allowed TBSB's request for the current appeal to be heard together with the other appeal between TBSB and Kerajaan Malaysia under Civil Appeal No. J-01(IM)(NCvC)-269-05/2026 ("Second Appeal"), in which Kerajaan Malaysia's application to strike out TBSB's Writ and Statement of Claim was allowed, and the action was dismissed in its entirety.

 

The Court of Appeal directed the parties to file the relevant submissions in respect of both appeals and further directed as follows:

 

i.          The next case management is fixed on 9 June 2027; and

 

ii.         The hearing of both appeals is fixed on 23 June 2027.

 

The Company will make further announcement(s) on the material development of the case in due course.
