Reference is made to the Company's earlier announcements dated 15 April 2024, 10 June 2024, 16 July 2024, 16 October 2024, 13 November 2024, 12 August 2025, 21 August 2025 and 13 October 2025 in relation to the arbitration between Top International Engineering (Malaysia) Sdn. Bhd. and SymLife Star Kiara Sdn. Bhd. (formerly known as TWY Development Sdn. Bhd.), a wholly-owned subsidiary of SymLife, arising from a project known as "TWY @ Mont Kiara".

1. The Company wishes to announce to the following appeals which were fixed for hearing this morning on 22 May 2026: 

(a) Court of Appeal Civil Appeal No. W-02(C)(A)-1989-11/2024 (Appeal 1989), being SymLife's appeal against the High Court's decision in dismissing SymLife's application to set aside the arbitral award; and 

(b) Court of Appeal Civil Appeal No. W-02(C)(A)-1990-11/2024 (Appeal 1990), being SymLife's appeal against the High Court's decision in allowing Top International Engineering's application to enforce the arbitral award. 

2. Please be informed that the Court of Appeal had unanimously dismissed Appeal 1989 and Appeal 1990 with costs of RM30,000-00 for each appeal. The brief grounds of the Court of Appeal are as follows: 

(a) the High Court was correct in finding that it does not fall under any grounds to set aside the arbitral award; 

(b) there is no reason to disturb the High Court's findings; and 

(c) even if the Court finds that the award is in conflict with public policy, it does not mean that the award will be set aside. It is discretionary and will not be exercised automatically and the Court must take a minimal intervention approach. 

The Company is seeking the Solicitors' advice for the application for leave to appeal against the Court of Appeal's decision to the Federal Court within 30 days from today.
