We refer to the Company’s announcement made on 1 August 2025 in respect of the Writ of Summons and Statement of Claim (“Claim”) dated 28 July 2025 for the Civil Suit, instituted by the Plaintiff against IBSB and the Company’s wholly-owned subsidiary, SDBP.

SDBP’s solicitors had filed SDBP’s Defence on 29 August 2025 (“Defence”) to the Claim pursuant to the directions of the High Court given at the case management of the Civil Suit on 29 August 2025.

SDBP through SDBP’s Defence has, inter alia, stated that:

(a)        SDBP has no knowledge of the allegations raised in the Claim.

(b)        IBSB is an independent contractor of SDBP.

(c)        There is no non-delegable duty owed to the Plaintiff.

(d)        The Plaintiff has no locus standi to mount the Claim against SDBP.

(e)        The Plaintiff’s Claim is barred by laches, acquiescence, waiver and/or estoppel.

(f)         The Plaintiff’s Claim is an abuse of process of the court.

The Civil Suit is fixed for further case management on 7 October 2025.

The Company will make the necessary announcements to Bursa Malaysia Securities Berhad as and when there are further developments in relation thereof and/or upon receipt of any further directions by the Court.
