1. INTRODUCTION

Selangor Dredging Berhad (“Company”) wishes to announce that its wholly-owned subsidiary, SDB Properties Sdn. Bhd. (“SDBP”) was served with a Writ of Summons dated 28 July 2025 by Condolink Sdn. Bhd. (“Plaintiff”) through their solicitors on 1 August 2025 (“Suit”). The Suit was instituted against our main contractor, Inta Bina Sdn. Bhd. (“IBSB”) and SDBP.

 

2. CIRCUMSTANCES LEADING TO THE WRIT ACTION

 

IBSB is the main contractor for SDBP’s development project known as “Cadangan Pembinaan Perumahan Berstrata  yang terdiri daripada Fasa 1: Blok A hingga C yang mengandungi 26 unit rumah teres superlink 3 tingkat dan Blok D hingga I yang mengandungi 196 unit kondo villa 3-4 tingkat” on land adjacent to the Plaintiff’s land Lot 1195 (“Lot 1195”). Through the Suit, the Plaintiff among others alleges that SDBP and IBSB have through themselves, their agents and/or employees, have unlawfully trespassed onto Lot 1195 by felling of trees, building workers’ quarters and road access. The trespass has, amongst others caused the Plaintiff to suffer loss. The Plaintiff also alleges that there is a duty of care not to trespass onto Lot 1195 and such duty is non-delegable as between SDBP and IBSB.

 

3. PARTICULARS OF CLAIMS

The particulars of the claims against both SDBP and IBSB (“Defendants”) jointly and severally are as follows:- (a) an injunction that the Defendants, their agents, and/or employees are restrained and prohibited from trespassing, occupying and/or entering onto Lot 1195; (b) a mandatory injunction that the Defendants carry out the repair works to reinstate Lot 1195 to its original condition; (c) In the alternative to prayer (b), if the Defendants shall fail to reinstate Lot 1195 to its original condition, the Plaintiff claims for damages to be assessed by the Court; (d) special damages in the sum of RM1,070,000.00; (e) general damages to be assessed by the Court; (f) aggravated damages; (g) exemplary damages; (h) Interest on special damages and/or general damages at the rate of at 5% per annum commencing from the date of filing the of the action until the date of full realisation; (i) cost; and (j) such further and/or other reliefs as the Honourable Court deems fit and proper.

 

The Company categorically denies the allegations made by the Plaintiff in the Suit including the alleged trespass or continuing trespass by SDBP. The Company believes that the Suit commenced by the Plaintiff is without merit and constitute a misapprehension of the facts and circumstances.

 

4. OPERATIONAL AND FINANCIAL IMPACTS ON THE COMPANY

The Company does not expect that there will be any material operational and financial impact to the Company and/or SDBP from the Suit.

 

5. DIRECTORS' AND SUBSTANTIAL SHAREHOLDERS' INTEREST

None of the Directors, Substantial Shareholders, or persons connected to them has any direct or indirect interest in the Suit.

 

6. STEPS TAKEN

SDBP has engaged legal counsel to represent and defend SDBP against the Plaintiff’s claims under the Suit. The Company is confident in the legal position and is of the view that SDBP has a good defence to the Suit.

 

Further announcements will be made as and when there are material developments in relation to the Suit.
